3. User Accounts & Eligibility

You must be at least 18 years of age or have parental/guardian consent to use our services. By placing an order, you represent that you are of legal age to form a binding contract. You are responsible for maintaining the confidentiality of any account information and for all activities that occur under your account.

4. User-Uploaded Content

  • You retain ownership of all photographs you upload to PhotoGiftStudio.
  • By uploading a photo, you grant us a limited, non-exclusive license to process and transform the image using our AI technology solely for the purpose of delivering your requested portrait.
  • You represent that you have the right to upload any photos submitted and that they do not infringe on any third party's intellectual property rights.
  • We do not claim ownership of your uploaded photos or the generated artwork.
  • Uploaded images are stored temporarily for processing and are automatically deleted within 30 days unless otherwise required to fulfill an order.

5. Generated Artwork & Intellectual Property

  • You receive full personal usage rights for all AI-generated portraits you create on PhotoGiftStudio.
  • You may use generated images for personal, non-commercial purposes including printing, sharing on social media, and gifting.
  • Commercial use of generated artwork (e.g., resale, use in advertising) requires a separate commercial license. Please contact us at [email protected] for commercial licensing inquiries.
  • The PhotoGiftStudio brand, logo, website design, and underlying AI technology remain our exclusive intellectual property.

6. Orders & Payment

  • All prices are listed in US Dollars (USD) unless otherwise stated.
  • Payment is processed securely through our third-party payment processor at the time of checkout.
  • We reserve the right to refuse or cancel any order at our discretion, including orders that appear fraudulent or violate these terms.
  • Digital downloads are delivered immediately upon successful payment via email and on-screen download link.
  • Physical products are subject to production and shipping timelines as described on the product page.

7. Shipping & Delivery

  • Standard shipping within the United States typically takes 5-7 business days after production.
  • International shipping may take 10-15 business days depending on the destination.
  • Shipping costs are calculated at checkout based on your location and selected products.
  • We are not responsible for delays caused by customs, weather, or carrier issues beyond our control.
  • Risk of loss passes to you upon delivery to the carrier.

8. Prohibited Uses

Refund Policy

At PhotoGiftStudio, your satisfaction is our top priority. We stand behind the quality of our AI-generated pet portraits and physical products. Please review our refund policy below.

1. Digital Downloads

  • We offer a 100% satisfaction guarantee on all digital portrait downloads.
  • If you are not satisfied with the quality of your AI-generated portrait, contact us within 14 days of purchase and we will either regenerate your portrait at no charge or issue a full refund.
  • Refund requests for digital downloads must include your order number and a brief description of the issue.
  • Refunds are processed to the original payment method within 5-10 business days.

2. Physical Products

Damaged or Defective Items:

  • If your physical product arrives damaged, defective, or with a printing error, contact us within 30 days of delivery.
  • Please include photos of the damaged/defective item along with your order number.
  • We will send a free replacement or issue a full refund at your choice.

Wrong Item Received:

  • If you receive the wrong product or the wrong portrait on your item, contact us immediately.
  • We will ship the correct item at no additional cost and provide a prepaid return label for the incorrect item.

Change of Mind:

  • Because physical products are custom-made to order with your unique pet portrait, we generally cannot accept returns for change of mind.
  • If you have concerns about your order before it ships, contact us as soon as possible and we will do our best to accommodate changes or cancellations.

3. Cancellations

  • Digital Orders: Digital downloads are delivered instantly and cannot be cancelled after delivery. However, you may request a refund under our satisfaction guarantee.
  • Physical Orders: Orders for physical products can be cancelled free of charge if the item has not yet entered production. Once production begins, cancellation is not possible, but our satisfaction guarantee still applies.

4. Shipping Issues

  • Lost Packages: If your order has not arrived within 15 business days (domestic) or 30 business days (international) of the shipping confirmation, please contact us. We will work with the carrier to locate your package or send a replacement.
  • Incorrect Address: Please ensure your shipping address is correct at checkout. We are not responsible for packages delivered to an incorrect address provided by the customer. Re-shipment to a corrected address will incur additional shipping charges.
